The offered positions pay considerably less than her original position but still within industry average range. She is required to respond in the next day or two or they will report it to the state as an offer rejection. The options available to us seem to be limited to: If she declines the offers she loses unemployment on top of already not receiving disability after labor. If she takes the job she will work for 1 week before going into labor. She no longer qualifies for FMLA due to her lay off so her job is not secure and we have no clue how long she will be allowed to be out. Additionally, disability is calculated using an avg of the last 10 weeks worked (which has been severely diminished). Not to mention the offered jobs are 8 hour shifts rather than 12, meaning we will have to pay more for child care ($65/day/child). She also loathes the idea of working at a long term facility due to chronic understaffing. We are at a loss with how to handle the situation at this point. EDIT: After more reading, I am not sure how this legally applies to my wife's situation if she worked 49 of the last 52 weeks with this employer and gets rehired.
